Civil Litigation

Civil Litigation

Many different types of legal disputes fall under the auspices of civil litigation. A civil litigation lawyer represents either plaintiffs or defendants in civil lawsuits. In most cases, they involve a dispute over money or property or the failure to fulfill an agreement. Civil litigation lawyers represent persons, companies or government agencies in a wide array of cases, including:

Personal injury cases – representation of persons injured in a car accident.

Business litigation – representation of businesses or companies in lawsuits in legal situations, including contract disputes, shareholder disputes, breach of contract, shareholder derivative suits, tax liability.

Construction litigation – representation of owners, contractors, subcontractors, or architects in both commercial and residential construction disputes including filing and enforcement of liens, delay claims, breach of contract claims and construction defect claims.

Contested Wills or Successions – Contesting a Will often involves whether or not the Last Will and Testament is in valid form, whether the Will was forged, and the mental capacity or the health of the Testator. Louisiana law specifically provides legal requirements that must be met in order for a testament to be valid. Contesting a Will or litigating a contested succession is a big decision. Prior to making that decision you should seek the advice of an experienced succession attorney to review the facts of a particular case to determine if a successful challenge to a testament can be made.
